ملخص البحث

Contracts, especially employment contracts which form the backbone of the economy, hold significant importance in society as they regulate the relationship between the worker and the employer within the framework of mutual obligations to achieve the execution of the contract and realize the objectives. However, these contracts are affected by circumstances beyond the parties’ control, known as force majeure. The idea addressed in this research is the impact of force majeure on the obligations of the parties to an employment contract. The aim of this research was to clarify the determinants of force majeure by explaining its concept. Additionally, the research addressed the effects of applying force majeure to employment contracts by highlighting the stance of Islamic jurisprudence and Palestinian Labor Law on the contractual relationship between the worker and the employer under such circumstances. The research concluded that there is a legislative shortcoming concerning the contractual relationship between the worker and the employer in the context of force majeure. One of the main recommendations presented in this research is the enactment of a legislative system to be applied in the event of force majeure, and the amendment of legislative provisions to clarify the legislator’s intent in these texts.
